Terms of service

These Terms govern your use of the Capvo desktop app, the API at api.capvo.app,
and the website at capvo.app (together, the "Service"). The Service is operated
by Capvo ("we", "us"). The full legal entity name and registration number will be
published here before public launch.
By creating an account or using the Service, you agree to these Terms. If you disagree, don't use the Service.
The service
Capvo records calls on your local device, transcribes them, stores the resulting transcripts on our servers, and exposes them to you via API, webhooks, and the Capvo desktop app.
We may change, add, or remove features over time. We will not remove a feature that your subscription explicitly entitles you to without notice and a refund of unused prepaid time.
Acceptable use
You agree not to use the Service to:
- Record any person without their knowledge or consent, where consent is required by the laws of the jurisdictions involved.
- Violate any applicable law, including export control, sanctions, or laws against unauthorised interception of communications.
- Reverse engineer, decompile, or attempt to extract the source code of the desktop app or the API, except as permitted by law.
- Resell the Service to third parties without a written agreement with us.
- Use the API to scrape, abuse, or otherwise interfere with our infrastructure.
You are responsible for ensuring you have the legal right to record any call you make through Capvo.
Your account
You must provide accurate registration information and keep it up to date. You are responsible for all activity under your account, including activity by anyone you share API keys with. Notify us immediately if you suspect a key has been compromised.
Your data
You own your data. We do not claim any rights over the audio you record, the transcripts produced from it, or any other content you create.
We process your data on your behalf as a data processor under RGPD. The Privacy Policy describes how.
You grant us the limited right to store, process, and transmit your data only as needed to operate the Service for you. We do not use your content to train models, sell access to your data, or share it with anyone other than the sub-processors listed in the Privacy Policy.
Plans and billing
The Free plan is available at no charge with the limits described on the Pricing page. Pro and Enterprise plans are billed monthly or annually in advance.
If your usage exceeds the limits of your plan, we will either rate-limit further requests or contact you to upgrade. We will not silently bill you for overages.
You can cancel a paid plan at any time. Cancellation takes effect at the end of the current billing period; we do not pro-rate refunds for partial months.
Termination
You can delete your account at any time from the desktop app. Account deletion is irreversible. Audio, transcripts, embeddings, and API keys are removed within 24 hours; backups are purged within 90 days.
We may suspend or terminate your account if you materially violate these Terms, fail to pay outstanding invoices after 30 days notice, or use the Service in a way that creates a security or legal risk to us or other customers. We will give you reasonable notice and an opportunity to cure where possible.
Service availability
We aim for 99.9% uptime on the API. We do not guarantee uptime for the Free plan. For Enterprise customers, we sign a separate Service Level Agreement that defines specific uptime targets and remedies.
Outages, planned maintenance, and incidents are reported on our status page (link TBD before launch).
Warranties and liability
The Service is provided as is. To the extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the extent permitted by law, our total liability under these Terms is capped at the amount you paid us in the twelve months before the event giving rise to the claim, or €100, whichever is greater. We are not liable for indirect, incidental, or consequential damages.
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be limited under French law.
Governing law
These Terms are governed by the laws of France. Any dispute is subject to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer protection law gives you the right to bring proceedings in your country of residence.
Changes
We may update these Terms. Material changes are announced via email at least 30 days before they take effect. If you do not agree to the change, you can cancel your subscription before it takes effect.
